In recent articles, I’ve discussed a pending lawsuit fighting the NFA. Dubbed the “One Big Beautiful Lawsuit,” Gun Owners of America and numerous partner organizations aim to complete the task the OBBB failed to accomplish in the Senate. I also mentioned that we are entering a new era of cooperation. The Firearms Policy Coalition, the Second Amendment Foundation, NRA-ILA, FRAC, the American Suppressor Association, GOA, and others are collaborating. This is a significant development. For years, the 2A community has been fractured, but now we are united—at least when it comes to activism.
Part of this approach includes attacking local and state laws that infringe on the Second Amendment. Recently, six gun rights organizations attacked New Jersey’s suppressor ban. Now, in a supporting move, the FPC has filed a lawsuit against the Garden State’s short-barreled rifle ban.
The Lawsuit
As part of its nationwide effort to eliminate bans on constitutionally protected arms, Firearms Policy Coalition, et al. v. New Jersey Attorney General Matthew Platkin, et al., challenged New Jersey’s total prohibition on “short-barreled rifles” (SBRs), defined in state law as those with a barrel shorter than 16 inches or an overall length under 26 inches.
“As the complaint explains, the Second Amendment guarantees the right of the people to keep and bear arms for lawful purposes, including self-defense, training, competition, and hunting. Yet New Jersey’s ban unconstitutionally and completely prohibits common firearms like SBRs. In the Garden State, it is a third-degree crime to buy, sell, or possess any SBR, punishable by 3 to 5 years in prison. But as the Supreme Court has held, the Second Amendment’s protection of arms ‘extends, prima facie, to all instruments that constitute bearable arms’—including the rifles at issue in this case.”
Lawsuits like this are aimed at dismantling overreaching state governments that’ve infringed on the rights of law-abiding citizens. Why would something be legal in one state that’s not legal in another?
Zooming Out
The only way gun owners and 2A enthusiasts can fight tyranny is through unity. It’s no longer practical or pragmatic for individual activist organizations to fight and succeed. Only when they work together can meaningful change occur. FPC and like organizations are doing just that.
