Senate Parliamentarian Strikes Land Sale

Aside from events in the Middle East, the “One, Big, Beautiful” Bill has been dominating news headlines. People from both sides have shared their opinions on the budget reconciliation bill. However, the opposition came to a head over Utah Senator Mike Lee’s proposal to sell off millions of acres of BLM (Bureau of Land Management) land. This has been a tricky bill for shooters and outdoorsmen.

On the other hand, the bill is the closest Congress has come to passing the Hearing Protection Act and the Stop Harassing Owners of Rifles Today Act (SHORT), which would remove suppressors, short-barreled rifles and shotguns, as well as AOWs, from the NFA. Something pro-2A advocates have been clamoring for. However, if it’s at the cost of millions of acres of public land, is it worth it?

Byrd Rule

Luckily, that tumultuous question has been rendered moot, at least for now. The Senate Parliamentarian has ruled that Sen. Mike Lee’s proposal to sell off millions of acres of BLM land fails to comply with the Byrd Rule.

First, what is the Byrd Rule? The Byrd Rule is a Senate mechanism that requires reconciliation bills to stay focused on fiscal issues, with non-budgetary provisions being subject to a point of order (a formal request to call attention to a perceived rules or procedures violation). This rule aims to trim unnecessary parts from overly inflated bills. Reconciliation bills also have an easier route to approval, which is why they tend to become inflated in the first place. While a simple majority is needed in the House, the filibuster complicates matters in the Senate, usually requiring 60 votes. However, there is no filibuster for reconciliation bills; only 51 votes are needed.

Parliamentarian

So, then, what is a Parliamentarian? The Senate parliamentarian is a nonpartisan advisor to the Senate, guiding rules, procedures, and legislative activities (think of them as an unbiased consultant). They advise the presiding officer, senators, and staff on matters of Senate rules, precedents, and statutes related to Senate proceedings. The parliamentarian also plays a key role in budget reconciliation, deciding what is permissible under the Byrd Rule. So they have the final say on what can and cannot be added to “One, Big, Beautiful” Bill.

Zooming Out

As of now, Sen Mike Lee’s proposal has been thrown out. Which is a massive win for sportsmen and women around the country. Our public lands are a sacred resource. However, in a post on X, Lee plans to write a new proposal. Here is what he intends to reframe:

  • REMOVE ALL Forest Service land. We are NOT selling off our forests.
  • SIGNIFICANTLY REDUCE the amount of BLM land in the bill. Only land WITHIN 5 MILES of population centers is eligible.
  • Establish FREEDOM ZONES to ensure these lands benefit AMERICAN FAMILIES.
  • PROTECT our farmers, ranchers, and recreational users. They come first.

 

These revised points take the criticism of his initial proposal and attempt to create something that will help the American people. But is taking public land helping anyone? This is a complex issue to reconcile. There is a housing crisis. However, is the solution selling off public land? It’ll be interesting to see whether the revised proposal passes the committee and the Byrd ruling.
